Consumption of Liquor

If you wish to consume liquor on Greater Shepparton City Council land, a Local Laws permit will be required.

Under Council's Community Living Local Law Number 1 2018; clause 9.1 states:

  1. A person must not, without a permit:

    1. on a road;
    2. in or at a public place;
    3. in or on a vehicle at any of these locations

    consume any liquor, or have any liquor in their possession or under their control, other than in a sealed container, unless the road or public place is part of a licensed premises or authorised premises pursuant to the Liquor Control Reform Act 1998.

  2. The consumption of liquor or possession of liquor in an unsealed container may be permitted in a public place proclaimed by resolution of Council from time to time.

Under Council's Community Living Local Law Number 1 2018, clause 9.2 states:

  1. If an authorised officer reasonably suspects that a person is in contravention of or has contravened clause 9.1, he or she may direct the person to dispose of the contents of any unsealed container.
  2. A person to whom a direction is given under this clause 9.2 must comply with that direction.

Council Land - Consumption of Liquor Permit

Permits to consume liquor on Council land are issued by Council's Local Laws department for the following locations:

  • Council Parks and Gardens (for example: Queen's Gardens, Victoria Park Lake)
  • Shepparton Showgrounds
  • Maude Street Mall
  • Any Council road or Council land (other than KidsTown - see below)

To apply for a permit to consume liquor on Council land at any site (except KidsTown), please complete the Consume Liquor in a Public Place Permit Application Form and return the completed application and payment to Council.

  • The application fee is non-refundable and is payable upon applying for a permit.
  • Applications (for events or activity with less than 50 attendees) must be received by Council's Local Laws department at least 14 days prior to the proposed date otherwise approval cannot be guaranteed.
  • Applications (for events or activities with over 50 attendees) must be received by Council at least 8 weeks prior to the proposed date.
  • Dates for an event or activity will only be approved a maximum of 2 months in advance.
  • Permits can only cover a maximum of a single event.
  • If any other Council permits are required, please contact the required Council department at least 8 weeks prior to the proposed event or activity.
  • The declaration must be signed by the Contact Person and returned with the application.

If approved, the written permit will be forwarded to the Contact Person advising of approval and any specific terms and conditions.

Booking fees, bonds, costs or other permits may be required from other Council departments, depending on the nature, size and time of the event. These costs may only be determined after an application is assessed.

The permit applicant will be required to demonstrate that:

  • they have Public Liability Insurance cover for a minimum of $20,000,000 for the event, or they have applied and have been accepted for Council's Insurance (please refer to application form for information)
  • they have completed an event booking form and hold a current booking permit for the space
  • they have obtained a current liquor licence from Victorian Commission for Gambling and Liquor Regulation (if required), or the catering company has obtained a current liquor licence from Victorian Commission for Gambling and Liquor Regulation (if required)
  • arrangements have been made for the supervision of those consuming alcohol to ensure that no person is intoxicated
  • no glass (including glassware and stubbies) will be used at any event outside
  • a risk assessment and safety procedures have been prepared and supplied to Council
  • a security plan is in place utilising licensed security guards (if required by Council Officers)
  • they have notified Victoria Police at the local police station of the event.
